Booking terms

Draft — not yet reviewed by a lawyer. This text is a template and not yet binding.

1. Who is letting the apartment

The landlord is the person named in the legal notice. What is let is the holiday apartment described on the listing page, in Calpe (Alicante), Spain. The apartment's official registration number is shown on that page.

These terms apply to bookings made directly through this site. If you book through Airbnb or another portal, that portal's terms apply.

2. How the booking is made

  • The listing page is not yet a binding offer.
  • By submitting the form you make a binding booking and accept these terms.
  • If you book by card, the booking is firm once the deposit has been received. Until then the dates are held for you for a limited time only. If the payment does not arrive, they are released again.
  • If you book without a card, the booking is firm once we have confirmed it to you.
  • Your booking page shows you at any time the dates, the number of guests, the total price, the deposit, the balance and when it is due. You receive the link by email. It is for this one booking and is not meant to be passed on.

3. What you pay

  • The total price consists of the nights, the final cleaning and, if you register dogs, the surcharge per dog per night. A valid returning-guest code is applied to the nights.
  • The full amount is shown to you before you submit. Nothing is added that is not shown there.
  • Electricity, water and gas are included in the price.
  • All amounts are in euros. Your bank's fees and currency conversion charges are yours to bear.

4. Deposit and balance

  • The deposit is due when you book. Its amount is shown in the listing and on your booking page.
  • The balance is due a set number of days before arrival. That period is also shown in the listing and on your booking page.
  • If your arrival is close enough, the full amount is due immediately. In that case there is no balance payment.
  • By booking you agree that we charge the balance to the same card on the stated date. You receive an email beforehand.
  • If the charge fails — European banks sometimes require an extra confirmation — we send you a payment link and a reminder. If the balance is still outstanding after that, we may cancel the booking. The cancellation policy then applies to the deposit.
  • Payment is handled by Stripe. We neither see nor store your full card number. For the balance payment the card stays on file at Stripe; on our side only the card type and the last four digits are recorded.

5. If you cancel

  • The cancellation policy shown to you in the booking form, and which you accept there, applies. It is part of this contract and takes precedence over these terms if the two conflict.
  • Send your cancellation by email. The day it reaches us is the day that counts.
  • For holiday accommodation with a fixed period there is no statutory fourteen-day right of withdrawal (Article 103(l) of Spanish consumer law, Royal Legislative Decree 1/2007). The cancellation policy above applies regardless.
  • If you arrive later or leave earlier, the nights not used are not refunded.

6. If we have to cancel

  • If we cannot make the apartment available, we tell you immediately and refund everything you have paid in full.
  • We will try to offer you equivalent accommodation nearby. You are not obliged to accept it.
  • Your further statutory rights are unaffected.

7. Arrival, departure and keys

  • We tell you the arrival and departure times and the key handover arrangements before you arrive.
  • Earlier arrival or later departure is possible only by arrangement and depends on the occupancy.
  • Please let us know if your arrival time changes. A person does the handover, not a machine.

8. Who stays in the apartment

  • Only the people you stated when booking may stay overnight, and at most the number given in the listing. Children count.
  • Additional people only with our prior consent. Without it we may turn them away or end the stay.
  • Subletting, passing on the apartment or the access, and events of any kind are not permitted.

9. Dogs

  • Dogs are welcome if you register them when booking and pay the surcharge. The number and the price are shown in the listing.
  • Beds, sofas and bedrooms are off limits to dogs.
  • The dog is not left alone in the apartment.
  • Whatever your dog leaves outside, you clear up.
  • For unregistered animals we may charge the surcharge afterwards.

10. Security deposit

  • Whether a security deposit applies and how much it is, is shown in the listing and on your booking page. We tell you before arrival when and how it is to be lodged.
  • It covers damage, missing items and cleaning beyond the usual.
  • After departure the apartment is checked and the deposit refunded. If we have to deduct anything, we tell you what for beforehand and back it up with photos and the costs.
  • The deposit is not a ceiling. If the damage is greater, you are liable beyond it. If it is smaller, you get the rest back.

11. How you treat the apartment

  • Treat the apartment, its furnishings and the shared facilities with care.
  • The rules of the residential complex and the notes in the house guide apply. You receive both before or on arrival.
  • Be considerate towards the neighbours. This is a quiet residential area, not a resort.
  • The pool and outdoor areas are shared. They are not supervised, use is at your own risk, and children must be supervised.
  • When you leave the apartment: close the windows, switch off the air conditioning and lock up.

12. Damage and defects

  • Tell us about damage and defects as soon as you notice them — including the ones you caused yourself. What we do not know about, we cannot put right.
  • You are liable for damage caused by you or the people travelling with you.
  • Normal wear is not damage. A broken glass is not a matter for the security deposit.

13. Reporting obligation towards the Spanish authorities

  • Spanish law requires us to record the details of all travellers and pass them to the Ministry of the Interior (Royal Decree 933/2021).
  • You are obliged to give us these details in full for everyone travelling with you and to present the identity documents. People aged fourteen and over sign themselves; for younger children the accompanying adult does so.
  • If we cannot meet this obligation, we may not hand over the apartment.
  • These details are kept for three years. Everything else is set out in the privacy policy.

14. Liability

  • We accept no liability for valuables you bring with you.
  • We are not liable for outages beyond our control — electricity, water, internet, building work in the neighbourhood. We do what we can to get them fixed quickly.
  • Our liability under mandatory law, in particular for personal injury, is unaffected.

15. Data protection

What happens to your data is set out in the privacy policy.

16. Complaints and applicable law

  • If something is wrong, tell us first and during your stay. Then we can still put it right.
  • Spanish law applies. Mandatory consumer protection provisions of the country you live in are unaffected.
  • We will make the official complaint forms (hojas de reclamaciones) available to you on request.

17. Other

  • Changes and side agreements are recorded in writing; an email is enough.
  • If a single provision is invalid, the remainder stays valid.
  • The version of these terms that was published on this page at the time of your booking applies.
